PROPOSITION AMENDMENTS TO TEXAS CONSTITUTION
NOVEMBER 5, 2013
 
 
Proposition #1:  The constitutional amendment authorizing the legislature to provide for an exemption from ad valorem taxation of all or part of the market value of the residence homestead of the surviving spouse of a member of the armed services of the United States who is killed in action.
 
I will vote yes.  I believe in supporting our military families.
 
Proposition #2:  The constitutional amendment eliminating an obsolete requirement for a State Medical Education Board and a State Medical Education Fund, neither of which is operational.
 
There has been no new loans made from the fund by the board in more than 25 years.  There isn't even any appointees to the board and receives no program funding.
 
I am voting yes.  I am also contacting my State Representative to discover who decided not to enforce this CONSTITUTIONAL AMENDMENT  and why. 
 
Proposition #3: 
 
The constitutional amendment to authorize a political subdivision of this state to extend the number of days that aircraft parts that are exempt from ad valorem taxation due to their location in this state for a temporary period may be located in this state for purposes of qualifying for the tax exemption.
 
I am voting no.  I have to wonder about the lobbyist who is pushing for this, but see no benefit to me.
 
Proposition # 4:
 
The constitutional amendment authorizing the legislature to provide for an exemption from ad valorem taxation of part of the market value of the residence homestead of a partially disabled veteran or the surviving spouse of a partially disabled veteran if the residence homestead was donated to the disabled veteran by a charitable organization.
 
Again, I am voting yes.  Our military deserves thank for their service.
 
Proposition # 5:
 
The constitutional amendment to authorize the making of a reverse mortgage loan for the purchase of homestead property and to amend lender disclosures and other requirements in connection with a reverse mortgage loan.
 
I will vote no.  I do not want to give banks the right to harass seniors.
 
Proposition #6:
 
The constitutional amendment providing for the creation of the State Water Implementation Fund for Texas and the State Water Implementation Revenue Fund for Texas to assist in the financing of priority projects in the state water plan to ensure the availability of adequate water resources.
 
I will vote no.  This proposition sounds like our Congressmen are planning a tax hike.
 
Proposition # 7:
 
The constitutional amendment authorizing a home-rule municipality to provide in its charter the procedure to fill a vacancy on its governing body for which the unexpired term is 12 months or less.
 
  I will vote no.  I believe the special elections giving voters a voice in our government is better than having our elected officials "appointed".
 
Proposition # 8:
 
The constitutional amendment repealing Section 7, Article IX, Texas Constitution, which relates to the creation of a hospital district in Hidalgo County.

I will vote yes, allowing the citizens of Hidalgo County power over themselves.
 
 
 
Proposition # 9:
 
The constitutional amendment relating to expanding the types of sanctions that may be assessed against a judge or justice following a formal proceeding instituted by the State Commission on Judicial Conduct.
 
 I will vote yes.   This amendment will expand the potential sanctions that the State Commission on Judicial Conduct can issue following a formal proceeding.  It will allow the Commission to issue an order of public admonition, a warning, a reprimand, or a requirement to obtain additional training or education in addition to the Commission's current authority to issue a public censure or recommend removal or retirement of a judge. 
 
 The state board of nurse examiners currently have the choice of the  "expanded sanctions" against nurses.  I believe judges could also benefit from these expanded sanction choices.

ARM YOURSELF TO PRESERVE THIS COUNTRY--COMMENTARY

   It hurts to be the smartest man in the room.  We have the established politicians in Washington, George Soros, and Mark Zuckerberg telling us how foreign criminals need to be given forgiven for breaking our laws so our economy will improve.  How stupid they all think you are!  I give you John Kerry who even said that Americans "have the right to be stupid".  Well, there you are.
   How will it benefit America to give foreign invaders our jobs, when we have an epidemic of people on welfare?  Why not put our legal citizens to work and kick the foreigners off welfare?  That makes more sense to me.  How many stories have you heard or read where a company has two openings and hundreds of applicants?  And big business wants to give those jobs to foreign criminals to depress wages.
   Established Republicans are obviously taking a lot of bribes from big business to push this law on us.  Have you read EXTORTION by Peter Schweizer?  How much time do you invest in keeping up with what is going on in Washington?  Have you even "liked" your Congressman's facebook page to see what he is up to and to give you a way to communicate with him?
   It doesn't matter how many tours of military duty you have served.  Every American has got to arm themselves with knowledge and then use wisdom to discern truth.  What are you doing to preserve this country for your children and grandchildren?  It is time to get in the fight to preserve our freedoms.
   Case in point is John Kerry giving the U.N. the power to disarm you.  He signed away our right to be a sovereign nation.  I can't wait until the socialists in Washington ratify it.
   Our elected officials are in Washington trying to eliminate our immigration system.  They want to give our country to foreigners and are being paid handsomely by big business and big money.  Are you going to allow them to ram more laws down our throats like they did Obamacare?
   Speaking of Obamacare, you would think that since it is such a great thing, that our President would be the first to sign up.  WRONG!  He just wants to force this monster on you and your elected officials are more than willing to accommodate him.
   Let me tell you about a state insurance for homeowners along the coast of Texas.  When Hurricane Ike hit, our poor homeowners were denied claims to restore their homes.  I know for a fact that there was one homeowner who had 180 photos of damage to his roof, even with glass embedded in the shingles from where the strong winds had carried broken glass.  His house was wrecked.  He and his wife were living in a travel trailer next to the house.  Texas Windstorm Insurance denied his claim.  The insurance company ran out of money and could not cover all the damaged homes.
   Fast forward to our federal government.  Your mind cannot even imagine the woes that people who are in need of medical attention will face.  Look at how Harry Reid and President Obama denied medical attention through the V.A. during this latest partial shutdown of the government that they staged.  Then, since the I.R.S. is in charge of the healthcare, and they targeted a certain segment of Americans for tax exempt status, imagine what will happen if the government doesn't like you.  You will be targeted and denied health care. 
   So, today, share this post with your friends.  "Search" your Congressman on facebook and "like" their pages.  Read true news reports at http://theblaze.com and http://breitbart.com.  Ask for help if you are unsure who is telling the truth.  Time is running out.    What are you willing to do for your children and grandchildren?

TODAY'S NEWSMAX STORY CONCERNING DEBT CEILING NEGOTIATIONS


   This is an excerpt from a story from Newsmax.com regarding the current "negotiations" being conducted in Washington.  They are quoting Senate Majority Harry Reid:

"We've made tremendous progress," Reid said at the end of a Senate session during a federal holiday, underscoring the urgency of settling a fiscal crisis that was nearing a Thursday deadline. The U.S. Treasury Department estimates it will reach a $16.7 trillion borrowing limit on Oct. 17.
"We hope that with good fortune ... that perhaps tomorrow will be a bright day," Reid said, hinting at the possible Tuesday announcement of a bipartisan Senate deal.

   Those of us who "test the spirits" have to analyze this statement.  When Senator Reid says, "We've made tremendous progress"  what he is saying is that he is the only elected official who matters and everyone needs to bow to him.  When Newsmax says, "Reid said at the end of a Senate session during a federal holiday, underscoring the urgency of settling a fiscal crisis that was nearing a Thursday deadline", what they are not saying is that Reid sent the Senate home early in this situation and rudely ignored the House's proposals and the work they were doing.  Reid stated with his actions that the House needs to obey him only, not their voters back home.
   When Newsmax says "The U.S. Treasury Department estimates it will reach a $16.7 trillion borrowing limit on Oct. 17th, they don't quote President Obama.   The President said on September 18th, "Raising the debt ceiling, which has been done over a hundred times, does not increase our debt".    The President went on to say, "the average person thinks that raising the debt ceiling must mean that we are running up our debt."  Well, duh, Mr. President.  So the "average person" is smarter than the President of the United States!
   Then Newsmax ends this excerpt by saying that Reid said these things, "hinting at the possible Tuesday announcement of a bipartisan Senate deal."  What that means is that Democrats and RINOs keep trying to force their will on American voters, who have shouted loudly that we are tired of their grandstanding.  We want the federal government to work for America.  We don't want Liberals continually ramming their agenda down our throats.
   We don't want obamacare
   We want our borders secured
   We want the Constitution upheld, like our "representatives" promised when they took their oath of office.
   We already have "a path to citizenship".  It is called "legal immigration".  We want foreign invaders prosecuted.
   We want welfare reformed to include ONLY Americans.
   We want our military taken care of like they were promised when they signed up or were drafted.
   We want "fast and furious" and "Benghazi" investigated and the criminals prosecuted.
   Is that too much to ask?

The Truth About the Health Care Bills - Michael Connelly, Ret. Constitutional Attorney

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.

What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government. 


However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare a direct violation of the specific provisions of the 4th Amendment to the Constitution, information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However , that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.  


So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law. It doesn't stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 ofthe Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

For those who might doubt the nature of this threat, I suggest they consult the source, the U.S. Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

YOU CANNOT BE A DEMOCRAT IF YOU ARE A CHRISTIAN

YOU CANNOT BE A DEMOCRAT IF YOU ARE A CHRISTIAN

   I made the statement the other day, "One does not have to be a Christian to be a Republican but cannot be a Democrat if they are a Christian."  The statement really did not get the response I had intended.  I guess only two people saw it.
   If we don't vote according to our religion, what guideline do we use?  Do we use the Constitution?  How many of us have read and understood the Constitution?  How many Amendments have been added?  Currently, there is a 28th Amendment floating around on facebook.  Do you know there is no 28th Amendment to the Constitution?
   What about the politicians?  Do we vote according to what they say or how they look?  With the invent of television and with more and more people having them in their homes, it has been easier for a good looking politician to win over a not-so-good looking one.  Did you know that?
   Then we have the bills and crises that our elected officials vote on.  How many of us are informed about what is up for a vote and understand what impact it will have on our country?  How many of us care?
   What is the differences in the current party platforms?  Do you know what a platform or a plank is?  Do you vote for a party who supports  your own special interest or who supports the Constitution?
   The sad fact of the matter is that not that many people read the Bible or know what is in it.  I would venture to say that even fewer read the Constitution and can determine how to apply it to the different issues our Country faces.  Case in point, I give you the Supreme Court.  We have judges appointed to the Supreme Court who prefer to legislate from the bench.  Do you even know what that means?  Do you care?
   I am sure that we all care.  We are so busy with making a living and caring for our families that sometimes we just want to sit down in front of the television and vegetate.  We need our "down time".  Keeping up with politics is time consuming and boring.  Well, not for me.  I would rather have politics than football.  That is quite a statement.
    Furthermore, most of us know SOMETHING about religion or the Bible, but how many of us know ANYTHING about the Constitution and what it says?  It is easier to bring religion into the conversation than it is to talk about what the Constitution says about a subject or a proceeding.  Case in point:  a tax cannot originate in the Senate, like Obamacare did, thus, it is unconstitutional.  As with our religion, we need to be informed about the Constitution so we can have an intelligent debate.
   So, when someone brings religion into the conversation about politics, they are saying they don't have a clue about the Constitution.  The Heritage Foundation has been giving free classes on the Constitution.  Yes, it requires a little investment of your time and effort to understand some of it, but isn't it worth it?  Isn't it worth it to be an informed consumer?  After all, you are paying Congress and the President and Vice-President to make and vote on the laws.  Maybe you should be informed as to whether you are getting your money's worth.
   It has recently come to my attention that Americans should be the most informed people in the world.  We can connect to our politicians and/or those running for office with just a few clicks of the mouse.  I have my elected officials connected to my facebook.  I listen to talk radio.  I have found a few online news blogs that I trust to keep me informed.  I am still searching for a Constitutional blog.
   We are also taught to "test the spirits" in the Bible.  We know that some of the issues we face as a nation are contrary to our "religion".  Those issues should be brought to the attention of our elected officials.  Big  business and special interest groups spend a lot of money to push their agenda.  We, the citizens who actually vote, should be spending a little time to communicate with the officials we send to Washington and push them to act on our behalf.  If they don't, we can fire them and hire someone who will work for us.  We have that power.
   I believe Sarah Palin said it right when she said, "The permanent political class cannot control the political process, thanks in large part to the rise of technology and new media..."  She also said something to the effect of  the paradigm has shifted for the financial elite and the political establishment.  The grassroots movement communicate with each other, sharing information on social media.  NOBODY believes anything the main stream media reports any more.  They have been caught in too many lies to further their own political causes.  They don't report the facts, but slant the truth to promote their agenda.
   We have all got to invest our time and get involved.  It is working.
